Argentine judicial courts issue rulings on jury trials and union disputes

In Chaco, the Superior Tribunal of Justice (STJ) has rejected two requests to implement jury trials in civil and commercial cases. While Law 3325-B allows for the progressive implementation of jury trials in specific matters such as extracontractual civil liability, the court ruled that current conditions are not met. The majority, including President Néstor Varela, determined that the proposed cases did not meet necessary criteria regarding social, political, or economic relevance, nor did they satisfy the institutional capacity requirements needed to ensure the mechanism functions correctly.

In Formosa, the Superior Tribunal of Justice dismissed a claim by the Asociación Judicial Formosa (AJUFSA) regarding the legitimacy of the Unión de Empleados de la Justicia de la Nación (UEJN) within the provincial judiciary. AJUFSA had requested clarification on the legal standing of the UEJN and the administrative basis for its recognition. The court ruled the request ‘improcedente’ (improper) and ordered the case to be archived, following reports that payroll deductions for the UEJN are based on existing administrative authorizations.
