Argentina Supreme Court upholds repeal of Land Law

The Argentine Supreme Court has sparked widespread protests and legal controversy following its decision to uphold the repeal of the Rural Land Law via Article 154 of DNU 70/2023. This decree, promoted by President Javier Milei, removes previous restrictions that limited foreign ownership of rural land to 15% of the national territory.

In response to the ruling, various political, labor, and social organizations, including the CTA and the Frente de Izquierda, held demonstrations in Buenos Aires and other regions to protest the potential 'foreignization' of Argentine territory. Protesters argued that the decision threatens national sovereignty and natural resources.

Due to a lack of unanimity among its members, the Supreme Court has called for two associate judges, Diego Barroetaveña and Juan Ignacio Pérez Curci, to participate in a new debate regarding a lawsuit filed by the environmental group Árbol de Pie. This group challenges the constitutionality of the decree based on environmental protection rights. While the Court previously dismissed a challenge by the Malvinas Veterans Center (CECIM) on procedural grounds, it clarified that the fundamental constitutionality of the land regime remains unresolved and subject to future legal challenges.
