Argentine Senate advances reform of Biofuels Law
The Argentine Senate has issued a favorable report on a comprehensive reform of the Biofuels Law (No. 27.640), aiming to establish a new regulatory framework for the next 15 years. The consensus-driven proposal, which unifies several legislative initiatives, seeks to transition from a state-controlled pricing and quota system to a deregulated, competitive market.
Key provisions include a progressive increase in mandatory blending rates: bioethanol in gasoline will rise from 12% to 15% after one year, while biodiesel in diesel will increase from 7.5% to 10% after twelve months. To support regional economies, the plan reserves specific percentages for bioethanol produced from sugarcane and corn. Additionally, the reform includes a provision allowing small and medium-sized enterprises (SMEs) until 2036 to undergo necessary industrial reconversions.
However, the proposal has met resistance from regional biodiesel SMEs, represented by CEPREB. These companies warn that the new scheme, which differentiates between integrated large-scale corporations and non-integrated regional plants, could threaten their operational viability and lead to market concentration. To mitigate this, the report includes a cap preventing any single company from controlling more than 20% of the total volume.
