Arica Court Upholds Eviction of Residents in Cerro Chuño, Chile

The Court of Appeals of Arica rejected a protection suit filed on behalf of residents of the Amanecer and Los Laureles villas in the Cerro Chuño settlement. In a unanimous ruling (case 581‑2026), the Second Chamber—comprising judges José Delgado Ahumada, Nora Bahamondes Acevedo and attorney Raúl Castro Cruz—found the petition lacked sufficient standing, noting the supporting list was incomplete, contained errors, and failed to adequately identify the alleged 4,300 affected inhabitants.

The court criticized the petition for vague constitutional arguments and procedural deficiencies, concluding that the eviction ordered by the regional authority could proceed.
