Arizona appeals court overturns sentence over AI victim video
The Arizona Court of Appeals has overturned the sentence of Gabriel Paul Horcasitas, a man convicted of manslaughter following a 2021 road rage incident that resulted in the death of Christopher Pelkey. While the manslaughter conviction stands, the court ordered a new sentencing hearing due to what it deemed a fundamental error in the original proceedings.
During the initial sentencing in Maricopa County, Judge Todd Lang was visibly moved by an AI-generated video presented by the victim's sister, Stacey Wales. The video featured a digital avatar of the deceased Pelkey, using his likeness and voice to express forgiveness toward Horcasitas and suggest a lenient sentence. The sister stated the video was intended to represent what her brother might have said if he were still alive.
The appellate court ruled that the judge was improperly influenced by the synthetic media, noting that the video did not document a real event but rather a family's perception of what the deceased might have thought. The ruling highlights the legal complexities and potential risks of using generative AI and deepfake technology within criminal justice proceedings.
