Arizona court overturns sentence after AI video of victim used in court

The Arizona Court of Appeals has overturned the 10-year prison sentence of Gabriel Paul Horcasitas, who was convicted of manslaughter for the 2021 road rage killing of Christopher Pelkey. The court ruled that the original sentencing was improper because it included an AI-generated video of the deceased victim addressing the defendant.

The video, created by Pelkey’s sister, Stacey Wales, used the victim's likeness, voice, and photos to depict him offering forgiveness to Horcasitas. The appeals court determined the video was unreliable, stating it was not a documentation of real events but rather a representation of the victim's thoughts created from the sister's imagination.

While the court vacated the sentence and ordered a resentencing, Horcasitas's manslaughter conviction remains intact. The original trial judge, Todd Lang, had reportedly reacted positively to the AI presentation during the initial sentencing hearing.
