Argentina seeks more time in U.S. Supreme Court YPF litigation

Argentina has requested a 30-day extension from the U.S. Supreme Court to respond to a petition for review filed by Burford Capital regarding the YPF litigation. This request follows a significant procedural development in which U.S. District Judge Loretta Preska formally annulled the $16.1 billion judgment previously issued against the country.

The annulment follows a March 2026 decision by the Second Circuit Court of Appeals, which overturned the original 2023 ruling. The appellate court found that the initial decision had misinterpreted Argentine law, specifically regarding the expropriation process of the state-owned oil company in 2012.

While the first-instance proceedings are effectively closed following Preska's latest resolution, the dispute remains active. Burford Capital, which represents the interests of minority shareholders including Eton Park and the Petersen groups, has asked the U.S. Supreme Court to review the appellate decision. If the extension is granted, Argentina will have until December 2 to submit its response.
