ASREM ordered to pay 300,000 euros for hospital Covid-19 death

The Court of Campobasso has held the Molise Regional Health Agency (ASREM) liable for the death of a patient who contracted Covid-19 during hospitalization. The court ordered the agency to pay more than 300,000 euros in compensation to the patient's family, in addition to interest and legal costs.

The ruling, issued by Judge Elisa Ferrazzoli, identified organizational deficiencies as the cause of the infection. Specifically, the court cited insufficient documentation regarding sanitization, inadequate personal protective equipment, lack of staff training, and insufficient testing of healthcare workers. Despite warnings from medical staff, the court found that adequate countermeasures were not implemented.

Furthermore, the court noted failures in clinical monitoring and patient assistance, which exacerbated the management of the disease. The ruling establishes a causal link between the facility's inefficiencies, the hospital-acquired infection, and the patient's death. The compensation covers both the damage suffered by the patient and the loss experienced by the family.
