Association for Legal Intervention appeals asylum rights ruling
The Association for Legal Intervention has filed a cassation appeal to the Supreme Administrative Court regarding a ruling by the Voivodeship Administrative Court in Rzeszów. The case concerns the refusal to accept and register an application for international protection from a foreigner who had entered deep into Polish territory after crossing the Polish-Belarusian border.
The lower court ruled that no inactivity occurred, citing legal provisions that allow for the limitation of the right to apply for international protection. The Association argues that this interpretation constitutes an impermissible restriction of the fundamental right to seek asylum. They further contend that such limitations should apply only at the state border and not be extended to individuals already within the country. The appeal also highlights potential contradictions with European Union Court of Justice jurisprudence.
