Asturias High Court confirms €330,000 indemnity in Trastévere case
The Superior Court of Justice of Asturias (TSJA) has dismissed appeals from the Grado City Council, the Principality of Asturias, and project promoters, upholding a ruling that mandates an indemnity of €330,346 plus interest. The payment stems from the closure of the gastrobar Moscón.
The dispute originated in February 2021 when the Grado City Council authorized the renovation of a listed building to transform it into a gastrobar, supported by a favorable report from the Principality’s Cultural Heritage Service. However, following a neighbor's complaint, courts annulled the licenses in 2022 because they violated urban planning legality.
The court confirmed the patrimonial liability of the administrations, with the Grado City Council responsible for 70 percent of the amount and the Principality of Asturias for the remaining 30 percent. The claimants, restaurateur Bernardo Álvarez and the company Trastevere Delicatessen S.L., sought compensation for damages caused by the irregular granting of the licenses.
