Atibaia judge rules on educational requirements for public exams

A judge in Atibaia, Brazil, has ruled that proof of educational qualifications in public service exams should only be required at the time of hiring, rather than during preliminary stages or when a candidate expresses interest in a vacancy.

Judge Rogério Correia Dias ordered the reopening of a deadline for a candidate who passed a competitive exam for a teaching position. The candidate had delayed expressing interest due to uncertainty regarding whether her diploma, expected in December, was required immediately. The court found that ambiguity in the recruitment notice justified the candidate's legal action to protect her right to the position.
