Australian regulator fines Sydney earthmoving firm after fatal heavy‑vehicle crash

The National Heavy Vehicle Regulator (NHVR) has warned all operators to review safety practices following the prosecution of a Sydney‑based earthmoving company for a fatal collision in November 2021. The heavy‑vehicle driver, who had longstanding health issues requiring 24‑hour oxygen support, collided with a light vehicle, killing the driver and injuring a passenger.

The company was found guilty of a Category 2 offence under the Heavy Vehicle National Law, fined AUD 1.2 million plus AUD 75,000 in prosecution costs, and placed under a 12‑month Supervisory Intervention Order requiring medical clearance or fitness‑to‑drive assessments for all staff and contractors. NHVR executive director Paul Alsbury said the incident “is a sad reminder of what can occur when an operator does not prioritise the safety of its employees, other road users and the community.” New HVNL rules effective 1 August 2026 will expand fitness‑to‑drive duties to cover physical illness, injuries, stress and mental health for drivers of vehicles over 4.5 tonnes.
