Australia's DAFF denies refunds for $26 million biosecurity fee surplus

The Australian Department of Agriculture, Fisheries and Forestry (DAFF) has announced it will not refund businesses following the revelation of a $26 million biosecurity cost-recovery surplus. During a Senate estimates hearing, DAFF Secretary Victoria Anderson stated that the department lacks the legal provisions to issue refunds, maintaining that individual service charges were applied correctly according to existing policy.

The surplus follows an inquiry by the Australian National Audit Office (ANAO) into the effectiveness of DAFF's cost-recovery arrangements. The ANAO found that the department had over-collected fees, failed to demonstrate that charges reflected minimum efficient service costs, and did not adequately manage risks regarding over-recovery and cross-subsidisation.

Secretary Anderson attributed the surplus to difficulties in accurately projecting import volumes, noting that increased import levels led to higher revenue collection. Senator Matt Canavan challenged this distinction, arguing that businesses would typically be expected to return overcharged funds to customers.
