Australia's NHVR Secures Landmark Heavy Vehicle Prosecution and Plans Tougher Enforcement Rules

The National Heavy Vehicle Regulator (NHVR) obtained a court injunction against a transport company and its director for repeated breaches of prohibition notices, marking the first use of the regulator’s powers to secure such an outcome. The court convicted both parties on all charges, fining the company $80,000 and the director $20,000, signalling a strong message to the industry about safety compliance.

A forthcoming amendment to the Heavy Vehicle National Law, effective 1 August 2026, will allow the NHVR to issue an improvement notice and commence prosecution for the same conduct. The change is expected to increase the regulator’s ability to pursue enforcement actions earlier in investigations and could lead to more frequent prosecutions of high‑risk operators across Australia.
