Austria Constitutional Court to review A2 motorway speed limit

The 80 km/h speed limit on the A2 South Motorway near Wiener Neudorf and Vösendorf has been referred to the Austrian Constitutional Court (VfGH). The legal challenge originated from a driver who was fined 35 euros for traveling at 90 km/h in the restricted zone.

The Lower Austria Administrative Court (LVwG) has requested the complete annulment of the speed limit regulation, which came into effect in December 2024. The court argues that the 80 km/h limit has been extended beyond the sections where noise measurements justify such a restriction, suggesting the expansion lacks sufficient legal grounds.

Cornelia Mayrbäurl, spokesperson for the Constitutional Court, stated that a decision is not expected before 2027 due to the required procedures, including gathering statements from involved parties. Until a ruling is made, the current speed limit remains in effect.

Local officials have expressed concern regarding the potential removal of the limit. Herbert Janschka, the Mayor of Wiener Neudorf, warned that lifting the restriction could lead to a health catastrophe by increasing traffic noise and pollutant exposure for the local population.
