Austria implements new nicotine product regulations and littering fines

New regulations regarding nicotine and tobacco products have come into effect in Austria as of August 20. The updated Tobacco and Non-Smoker Protection Act now explicitly includes next-generation nicotine products, such as nicotine pouches, nicotine toothpicks, and nicotine powders, even if they do not contain tobacco. This also extends to products that mimic tobacco use and may contain caffeine or CBD.

The Austrian Health Insurance Fund (ÖGK) welcomed the changes, noting that modern delivery methods do not eliminate health risks. Medical experts, including pulmonologist Ulrich Radda, warned that nicotine remains highly addictive regardless of whether it is consumed via traditional cigarettes, e-cigarettes, or pouches. There is particular concern regarding flavored products and attractive packaging that may encourage use among children and adolescents.

Additionally, the law introduces strict penalties for littering. Discarding cigarette butts or similar nicotine product waste in public children's and youth playgrounds is prohibited. Violators face administrative fines of up to 500 euros, which can increase to 2,000 euros for repeat offenses.
