Austria refuses extradition of Dmytro Firtash to the United States
Austria has concluded its extradition proceedings for Ukrainian billionaire Dmytro Firtash, refusing to surrender him to the United States. The decision follows a nearly 12-year legal battle involving federal allegations of bribery, racketeering, and money laundering.
The case collapsed due to a procedural error by Vienna prosecutors. A lower court had ruled that Firtash possessed diplomatic immunity stemming from a Belarusian appointment linked to the United Nations Industrial Development Organization (UNIDO). Although prosecutors attempted to appeal, they missed the statutory two-week deadline by following an unauthorized four-week window previously suggested by a judge. The Vienna Higher Regional Court has since dismissed the late appeal, making the immunity ruling final within Austria.
While this represents a significant setback for the U.S. Department of Justice, the underlying federal indictment in Chicago remains active. The ruling specifically prevents his extradition from Austria but does not vacate the American arrest warrant or prevent U.S. authorities from seeking his detention should he enter a jurisdiction that does not recognize his diplomatic status.
