Austria to implement new rights for people with disabilities

Starting in September 2026, new regulations will take effect in Austria regarding medical assessments and social benefits for people with disabilities.

A key change is the legal right to be accompanied by a trusted person during medical assessments conducted by the Pension Insurance Institution (PVA). Previously, this right was limited to assessments for care allowances, but it will now extend to evaluations for disability, incapacity to work, or occupational disability pensions. The rule also applies to medical examinations commissioned by the Social Ministry Service, such as those determining the degree of disability for disability passes or parking permits.

This reform implements a long-standing demand from the Austrian Disability Council. While the council has welcomed the measure, its president, Klaus Widl, noted that further improvements are needed, including better-trained assessors, barrier-free assessment environments, increased transparency, and simplified complaint processes. Additionally, stricter rules regarding unreported employment will apply to those receiving unemployment benefits or emergency assistance.
