Austrian Supreme Court Rules Most Ryanair Extra Fees Illegal
Austria’s Supreme Court ruled that 14 of the 15 surcharge clauses in Ryanair’s transport conditions violate consumer protection law. The decision bans hidden add‑on fees such as airport check‑in, boarding‑pass, child, mandatory family‑seat and name‑change charges for bookings made in Austria, effective from mid‑September. Consumer groups say passengers who paid these fees can seek refunds, and the ruling is seen as a strong signal that low‑cost airlines must display clear, lawful pricing.
The judgment follows a lawsuit brought by the Consumer Information Association on behalf of the social ministry, which argued that the fees were opaque and disproportionately disadvantageous. The court’s ruling is expected to affect Ryanair’s pricing model in the Austrian market and may prompt similar legal challenges elsewhere in Europe.
