Avixa fined 24 million lira for anti‑competitive nose‑spray practices

Turkey’s Competition Authority (Rekabet Kurumu) concluded that Avixa İlaç Sanayi ve Ticaret AŞ abused its dominant position in the dual‑active nasal spray market. The regulator found that Avixa, together with its affiliate Avigem İlaç Sanayi ve Ticaret Ltd. Şti., limited the supply of one of two identical‑formula sprays so that the product sold to the Social Security Institution at a higher discount held less than 1 % of market share. This “cheap‑product” scheme restricted consumers’ access to affordable medication and hindered rivals’ market entry. As a result, the Authority imposed a fine of approximately 24 million Turkish lira, ordered the suspension and cancellation of the product’s licence, and required the drug to be removed from the Social Security reimbursement list.

The decision underscores Turkey’s enforcement of competition law in the pharmaceutical sector and aims to protect consumer access to competitively priced medicines.
