Bac Ninh land registration guidance issued by Ministry

The Ministry of Natural Resources and Environment has provided guidance regarding the issuance of land use certificates for garden land purchased via handwritten documents in Bac Ninh. The inquiry involved a family seeking to formalize ownership of over 300 square meters of perennial crop land purchased in 2015, which lacks official certification despite stable, long-term use.

The Ministry stated that while it cannot provide a specific resolution without access to local archives and specific case files, it outlined the general legal principles. Under current land laws, individuals using land without a certificate must prepare a dossier to request first-time registration and certification.

Resolution depends on the land's origin, usage history, and relevant transfer documents. Furthermore, under Decree No. 49/2026/ND-CP, provincial People's Committees are responsible for establishing the specific administrative procedures and required documentation for land registration and certification within their respective localities.
