Baden-Württemberg expands smoking ban to include e‑cigarettes and public spaces

From 1 June 2026 the revised Non‑Smoking Protection Law in Baden‑Württemberg bans smoking of cigarettes, e‑cigarettes, shishas and vaporizers in all publicly accessible indoor venues, on school grounds and playgrounds, at bus and tram stops, and in certain outdoor areas such as zoos, amusement parks and open‑air swimming pools. The law aims to strengthen health protection for children, adolescents and other vulnerable groups.

Designated smoking rooms remain permitted in restaurants, discotheques, shisha bars, casinos and similar venues, provided they are fully separated, sign‑posted and restricted to adults. Small establishments under 75 m² may allow smoking if only cold food is served. Beer‑, wine‑ and festival‑tents are exempt, as are specific medical, artistic or investigative settings. Local police enforce the rule; first‑offence fines can reach €200 and €500 for repeat violations, while operators who fail to comply can face higher penalties.

The regulation also extends to vaping products regardless of nicotine or cannabis content, aligning the ban with current societal and technological developments.
