Barcelona residents sue Generalitat over L9 metro sinkhole

Residents affected by a sinkhole caused during the L9/L10 metro tunnel excavation works in Sant Gervasi-la Bonanova, near the El Putxet station, are filing a collective lawsuit against the Generalitat this week.

The legal action, represented by lawyer Carmen Pérez Pozo-Toledano, seeks compensation for material, economic, and moral damages. The lawsuit is based on the principle of ‘culpa in vigilando’, holding the Generalitat responsible as the project promoter for failing to ensure the works were executed correctly.

Claims include physical and psychological damage resulting from evacuations, structural damage to buildings, loss of income for local businesses, and potential decreases in property values. As of late August, 18 families and seven commercial premises remain unable to return to their properties. Authorities estimate that residents may not be able to return to their homes until early 2027 due to the extensive safety and stabilization work required.
