The second chamber of the Administrative Regional Court of Puglia dismissed the urgent injunction requested by La Lucente S.p.A. to halt the five‑year concession for the San Nicola stadium in Bari. The court found insufficient legal basis (no fumus boni iuris) and no imminent risk of serious damage (no periculum), so the concession process remains active and the municipality retains its authority over subsequent acts.

The decision does not transfer the concession to SSC Bari and leaves the substantive merits of the case for a later hearing, scheduled for February 2027. The single bid submitted by SSC Bari will now be examined by the awarding commission without judicial interference.

The ruling underscores the court's view that the procedural clarification issued by the municipality during the tender was timely and did not justify an immediate suspension of the procedure.
