Basf wins patent infringement lawsuit in China
Basf has secured a final legal victory in China against a local company for the unauthorized use of its patented active ingredient, saflufenacil. The patent dispute centered on a specific solid synthesis form of the ingredient, which is marketed in Brazil under the brand name Heat.
The Nanjing judiciary ruled that the local company violated Basf's intellectual property rights. Following the initial ruling, the infringing company appealed to the Supreme Court but subsequently withdrew the appeal, making the Nanjing decision final. The court has ordered the company to cease the manufacture, sale, and export of products utilizing the technology and to pay compensation to Basf.
While the legal effects of this specific ruling are limited to China, Basf noted that the patent is also active in Brazil. The company stated it will monitor the Brazilian market for any unauthorized economic exploitation of this technology.
