Basque Government grants semi-liberty to ETA convict Besance Zugasti

The Basque Government has granted semi-liberty to Juan Carlos Besance Zugasti, a former member of ETA involved in the 2001 murder of UPN councilman José Javier Múgica and an attempted attack on socialist counselor José Ramón Recalde. Besance Zugasti, currently held in Basauri prison, will be permitted daily leaves under article 100.2 of the penitentiary regulations. The Collective of Victims of Terrorism (Covite) has criticized this move, labeling it a “hidden amnesty” for ETA members.

Simultaneously, the National Court Prosecutor has appealed the granting of third-degree prison status to Idoia Mendizabal Mujika. The appeal, filed on October 1, has a suspensive effect, reverting Mendizabal to second-degree status at the Zubieta prison. Mendizabal, a member of the 'Olaia command', was sentenced to 377 years for a 2002 bombing attack against Esther Cabezudo. While the legal status has changed, she had previously been utilizing daily leaves under article 100.2.

The prisoner support network Sare has responded to the prosecutor's appeal by calling the decision “vengeance” rather than an act of justice, citing concerns over the rights of Basque prisoners during an upcoming electoral process.
