European Union implements EmpCo Directive to ban vague green claims
The European Union is implementing the Empowering Consumers for the Green Transition (EmpCo) Directive, which takes effect on 27 September 2026. This regulation aims to combat greenwashing by imposing strict rules on environmental and sustainability claims made by companies.
Under the new rules, generic terms such as ‘green’, ‘eco-friendly’, or ‘ecological’ are prohibited unless they are backed by robust evidence and meet specific European or national standards. Furthermore, claims of carbon neutrality based solely on carbon offsetting are no longer permitted. The directive also targets planned obsolescence and requires companies to provide transparent information regarding product lifespan, repairability, and the availability of spare parts.
To prevent a proliferation of misleading certifications, the directive mandates that sustainability labels must be based on independent verification or official authority recognition. Private, uncertified company labels will be banned. Non-compliance can lead to significant penalties, including fines of up to 4% of a company's annual turnover. While the rules apply to all companies operating within the EU, including imported goods, some nations like Austria have established a three-year grace period for products already on the market before the effective date.
