Bavaria faces massive backlog of income tax appeals

In Bavaria, there are approximately 335,340 ongoing appeals against income tax assessments as of June 30. Data provided by the Bavarian Ministry of Finance in response to an inquiry from the Green Party reveals that nearly half of these cases—157,391 appeals—have been pending for more than two years.

Tim Pargent, the financial policy spokesperson for the Green Party, has called for a binding maximum duration for processing such appeals, arguing that the state should be held to similar deadlines as citizens are for tax filings. He emphasized the need for concerted action to reduce the backlog of old cases.

The number of cases handled by specialized legal remedy offices within tax offices has also seen a significant increase, rising from 54,527 at the end of 2022 to 71,994 by late July 2026. This surge coincides with a decline in administrative capacity, as the number of full-time equivalent positions for processing these cases fell from 451.06 in 2020 to 444.33 six years later.
