Bavarian Court clarifies disability 'H' marker rules for adults
The Bavarian State Social Court (Bayerisches Landessozialgericht) has clarified the legal standards for maintaining the 'H' marker (Hilflosigkeit/helplessness) on disability certificates upon reaching adulthood.
In a recent ruling involving a young man with autism, the court upheld the removal of the 'H' marker. The court determined that while reaching the age of 18 changes the legal criteria for assessment, the marker cannot be removed automatically based on age alone. Instead, an individual case assessment must determine if the strict requirements for helplessness in adulthood are still met.
In this specific case, the court found that the individual was able to independently manage essential self-care tasks, such as washing, dressing, eating, and shopping. The assistance provided by parents was deemed to consist primarily of cognitive impulses and structural support rather than the physical or practical help required to meet the legal definition of helplessness.
