BC Court of Appeal Upholds Injunction Keeping Okanagan Indian Band Providing Fire Protection at Parker Cove

The British Columbia Court of Appeal dismissed the Okanagan Indian Band’s (OKIB) request to overturn a lower‑court injunction, meaning the band must continue supplying fire protection and emergency services to the Parker Cove development on the west side of Okanagan Lake.

The dispute began in December 2025 when Parker Cove Properties Limited Partnership failed to pay roughly $235,000 in fire‑protection invoices, arguing the billing was based on an unfair taxation model and an invalid agreement. After the band threatened to cease services, a BC Supreme Court judge ordered an injunction in April, rebuking the band for misrepresenting its finances and describing its termination notice to residents as “shocking.” The appellate court upheld the injunction, finding OKIB had not met the legal threshold to overturn the order. Fire protection will therefore remain in place pending a trial scheduled for 2027.
