Belate tunnel works stalled after Navarre Government legal setback

The Government of Navarre faces a significant legal setback regarding the Belate tunnel construction project. The administration's Legal Advisory department has rejected a proposal by the Department of Territorial Cohesion to pay 8.3 million euros in cost overruns to the UTE consortium, which includes Acciona and Excavaciones Osés.

The government had intended to settle these costs through the principle of unjust enrichment, treating them as independent works outside the original contract. However, the legal rejection necessitates a technical review of pending works, and construction is currently largely halted, specifically regarding the excavation of the lower gallery.

Regional officials stated that all scenarios remain open as they seek a resolution. The companies involved have expressed a willingness to reach an agreement. The disputed 8.3 million euros cover expenses such as a new truss model, powder magazines, a water treatment plant, and losses in excavation performance.
