Belgium prepares forced nationalization of nuclear plants

Prime Minister Bart De Wever has ordered the drafting of legislation that would allow the Belgian state to forcibly nationalize the country’s nuclear power plants. This move comes as a response to a deadlock in negotiations with the French energy operator Engie regarding the takeover of Belgium’s nuclear portfolio.

The negotiations, which began in April, involve the transfer of seven reactors located at Doel in Flanders and Tihange in Wallonia, along with associated personnel, assets, and multi-billion-euro decommissioning liabilities. A primary point of contention is the estimated cost of dismantling the fleet, which is projected to be between €11 billion and €12 billion, while Engie has signaled it will not exceed its provision of €8.7 billion.

If a voluntary agreement is not reached by the November 4 deadline, the state could use the proposed legal framework to unilaterally determine compensation for Engie. While Engie would retain the right to challenge such decisions in court, the Belgian government would be permitted to proceed with its nuclear strategy and reactor life extensions in the interim.
