Belo Horizonte supermarket ordered to indemnify elderly customer
A supermarket in Belo Horizonte has been ordered to indemnify an 80-year-old customer after an accident involving a shopping cart. The incident occurred in February 2024 in the Cachoeirinha neighborhood, where a cart loaded with over 100 products tipped over on a ramp, striking the woman and fracturing her ankle.
A medical report indicated the accident resulted in a 30% loss of motor function and permanent walking impairment. The judge ruled in favor of the consumer, citing the duty of safety and the protection of the elderly under the Consumer Defense Code and the Statute of the Elderly. The court set moral damages at R$ 15,000 and material damages of R$ 626.98 for medical expenses.
