Bemaks overturns 10 million euro Hajla–Štedim ski center tender

The Commission for the Protection of Rights in Public Procurement has annulled a decision by the Ministry of Public Works regarding the selection of the most favorable bid for the construction of a base station at the Hajla–Štedim ski center in Rožaje. The ruling follows an appeal by the company Bemaks.

The tender, valued at approximately 10.9 million euros including VAT, involves the creation of a main project and the execution of works for the construction and equipping of the base station. The Ministry had previously selected a consortium consisting of Indel inženjering and Tofi, who offered a price of 10.4 million euros, while Bemaks' bid was deemed invalid and ranked second.

Bemaks challenged the Ministry's assessment of the consortium's bid, specifically questioning the division of tasks between consortium members, the proof of professional and staffing capacities, and compliance with tender documentation. The Commission found the grounds for the appeal to be valid, noting uncertainties in how the Ministry concluded the consortium had formed a joint appearance agreement in accordance with public procurement laws.
