Benalmádena 2024 budget annulled by Andalusian High Court

The High Court of Justice of Andalusia (TSJA) has annulled the 2024 budget for the Benalmádena City Council. This was the first budget approved by Mayor Juan Antonio Lara’s administration.

The court ruled in favor of appeals filed by the PSOE spokesperson, Sandra Ochoa, and the State Attorney's Office. The decision follows a report from the Court of Auditors, which found that the budget failed to meet legal requirements for effective leveling. Specifically, the court noted that revenue forecasts lacked “reasonability and congruence,” as they did not align with previous years' actual income or municipal treasury estimates. The report highlighted that projected amounts, particularly regarding municipal capital gains tax, were “insufficiently justified.”
