Berlin court upholds ban on demonstrative religious rites at school

The Berlin Administrative Court has ruled in favor of the Diesterweg Gymnasium, allowing the school to prohibit the “demonstrative exercise of religious rites” on its premises. The decision follows a legal challenge by the Gesellschaft für Freiheitsrechte (GFF), which argued that the school's policy violated anti-discrimination laws by disproportionately affecting Muslim students.

The school administration justified the ban by citing specific conflicts, including instances where large groups of students dressed in black gathered on the schoolyard for public group prayers. The court acknowledged that while the rule may constitute indirect discrimination against Muslim students, the restriction is proportionate and lawful to protect school peace and prevent conformity pressure on other students.

Michael Hammerbacher, head of the Berlin Association for Democracy and Diversity in Schools and Vocational Training, welcomed the ruling. He noted that the distinction lies in the difference between private prayer and public, demonstrative gatherings that can send missionary signals or exert pressure on classmates.
