Berlin Court Upholds Driver License Revocation Over High THC Levels

In a July 2026 ruling, the Verwaltungsgericht Berlin rejected a driver’s emergency request to regain his licence after a traffic stop in early 2025 revealed a THC concentration of 47.8 ng/ml – far above the 3.5 ng/ml legal limit and the 8 ng/ml threshold indicating chronic use. Police noted the driver’s red eyes and the smell of cannabis during a night‑time check. The licensing authority had ordered the driver to submit a medical‑psychological assessment (MPU); he failed to do so, prompting the revocation of his licence.

The court held that, despite the recent legalization of cannabis in Germany, regular high‑frequency consumption remains a valid ground for doubts about fitness to drive and does not become excused by a medical prescription. The decision can be appealed to the Oberverwaltungsgericht Berlin‑Brandenburg.
