Berlin Data Protection Commissioner rules political microtargeting illegal

The Berlin Data Protection Commissioner has ruled that the use of political microtargeting during the 2021 German federal election was illegal. The decision issued reprimands and warnings to the CDU, SPD, Alliance 90/The Greens, and Die Linke.

The authority determined that these parties violated the European General Data Protection Regulation (GDPR) by processing sensitive data regarding the suspected political interests of online users to serve targeted advertisements, such as on Facebook. The investigation found that there was no sufficient legal basis, such as explicit consent, for this type of data processing.

The proceedings were triggered by 2021 research from ZDF Magazin Royale, which used a browser extension to track election advertising. The complaints were supported by the European data protection organization Noyb. While the four parties have been sanctioned, legal proceedings regarding the AfD are still pending.
