Berlin drafts salary repair law following unconstitutional pay ruling
Berlin is working to implement a salary repair law following a Federal Constitutional Court ruling that found the city's civil servant compensation unconstitutional for significant periods between 2008 and 2020. The court determined that 95 percent of the salary scale A failed to meet the constitutional requirement of 'amtsangemessene Alimentation,' which mandates that pay must reach at least 80 percent of the median equivalent income.
Berlin has until March 2027 to establish compliant regulations. The Senate Department for Finance has drafted a repair law intended to be introduced to the newly constituted parliament immediately following the upcoming elections.
The German Firefighters' Union (dfeug) has expressed strong criticism of the draft. The union argues that the proposed measures appear designed to minimize financial consequences for the state rather than providing a genuine solution. Specifically, the dfeug objects to provisions that may require civil servants to prove they timely objected to underpayment in order to qualify for compensation, suggesting this could damage the relationship between employers and employees.
