BioMarin and Ascendis Pharma settle global patent dispute

BioMarin Pharmaceutical Inc. and Ascendis Pharma A/S have entered into binding agreements to resolve a global patent dispute regarding the achondroplasia treatment Yuviwel. The settlement concludes litigation across multiple jurisdictions, including a Section 337 investigation by the US International Trade Commission, which BioMarin has agreed to withdraw.

Under the terms of the agreement, Ascendis will pay BioMarin royalties of 20% on Yuviwel’s net sales in the United States and 18% on net sales in the European Union, Brazil, and South Korea. These payments are retroactive to the drug’s initial commercial launch and will continue through May 20, 2030. In exchange, BioMarin has granted Ascendis a non-exclusive, worldwide, royalty-bearing license for navepegritide, the active compound in Yuviwel, allowing for its continued development and commercialization.
