Board of Grievances overturns salary deduction for visually impaired employee
The Board of Grievances has issued a judicial ruling overturning a decision by an employer to deduct salary from a visually impaired employee. The ruling, issued by the Administrative Court in Medina and upheld by the regional Administrative Court of Appeal, found that the deductions were unjustified because the employee's failure to use a fingerprint attendance device did not constitute absence or negligence.
The employee, a central operator, argued that frequent movement to the fingerprint device was difficult due to his visual impairment. The court determined that the employer had previously accepted his excuse and exempted him from the fingerprint system due to his health condition. Furthermore, his direct supervisor confirmed his regular attendance and performance of duties. The court concluded the decision was flawed and ordered its cancellation.
This ruling was released in conjunction with the Seventh International Conference on Disability and Rehabilitation. It is part of the Board of Grievances' efforts to raise awareness regarding judicial protection for the rights of persons with disabilities and to emphasize the importance of accommodating their specific circumstances.
