Brazil Supreme Court validates Bolsa Família benefit adjustment
The Brazilian Supreme Federal Court (STF) has ruled that the recent adjustment to the Bolsa Família social program is constitutional and does not violate electoral laws. Justice Gilmar Mendes, acting on a request from the Attorney General's Office (AGU), determined that the 15.04% increase is a periodic monetary correction based on the accumulated INPC inflation index between March 2023 and August 2026, rather than the creation of a new benefit or an illegal electoral measure.
Under Decree No. 13.120, the minimum family benefit will rise from R$ 600 to R$ 691, while the average monthly benefit is expected to increase from R$ 675 to R$ 777. Specific adjustments include the Benefício de Renda de Cidadania rising from R$ 142 to R$ 164 per person, and the additional benefit for children up to seven years old increasing from R$ 150 to R$ 173.
The new values are scheduled to take effect in October, with payments beginning on October 19. Finance Minister Dario Durigan stated that the adjustment is already accounted for in the budget, with an estimated fiscal impact of R$ 5.8 billion for the current year and R$ 22.7 billion for 2027. The ruling addresses concerns raised by political opponents who argued the timing of the increase, occurring shortly before the October general elections, was intended to influence voters.
