Bombardier Recreational Products sued over fatal Sea-Doo Switch capsizing

Families are suing Bombardier Recreational Products (BRP), BRP US, and Richardson’s Boat Yard following a fatal capsizing incident on Flagstaff Lake in Maine during Labor Day weekend 2025. The lawsuit, filed by Berman & Simmons, alleges wrongful death, negligence, and breach of warranty after a 2024 Sea-Doo Switch pontoon boat flipped, killing three passengers: Farhana Nasir, Noor Nasir, and Kiran Akbar.

The incident occurred while the vessel was traveling at approximately six miles per hour in calm conditions. The front port side of the boat reportedly dove into the water, causing it to capsize. Two other passengers, Khizer Nasir and Hassan Akbar, survived the incident but suffered physical injuries and emotional distress.

The lawsuit highlights that the Sea-Doo Switch model had been subject to a recall by BRP months prior to the accident due to a known risk of the boat nosediving and flipping. The plaintiffs contend that BRP knew or should have known the vessel was unseaworthy and that the dealer should have been aware of the propensity for capsizing. The legal action seeks unspecified damages, including funeral expenses.
