Bombinhas court orders removal of gate blocking beach access

A court has ordered the removal of a private gate blocking Rua Chicharro, which serves as the access point to Praia da Sepultura in Bombinhas, Santa Catarina. The decision follows a civil public action filed by the 1st Prosecutor's Office of the Porto Belo District.

The Public Ministry of Santa Catarina (MPSC) argued that the street is a public asset and its obstruction violates the right to free movement and collective access to the beach. While the municipality of Bombinhas acknowledged the area is public and previously committed to removing the barrier, the MPSC noted that these measures were never implemented.

The court has granted a 30-day deadline for the complete removal of the obstacle, under penalty of a daily fine. The municipality stated it is awaiting official notification to comply with the decision and is working to identify those responsible for the installation of the gate.
