Boyacá Courts Rule on Municipal Building Maintenance and Contractor Benefits
A popular action was filed in the Octavo Administrative Oral Court of Tunja by resident Cristian Fernando Cuervo Aponte, demanding that the municipality of Ventaquemada repair and maintain its mayor's office building. The court admitted the case, ordered the municipal legal representative, the public prosecutor and the ombudsman to participate, and gave the municipality ten days to respond, placing the mayor Oscar Camilo Montañez Bohórquez under pressure to disclose any maintenance plans or resources.
Separately, the Administrative Tribunal of Boyacá (Sala de Decisión No. 2) issued a ruling on 28 May 2026 that limited the recognition of social benefits for service contractors when not supported by law. The case, brought by Wilder Iván Suesca Ochoa against the Boyacá Comptroller’s Office, sought to nullify a fiscal‑responsibility finding and recover more than $54 million. The tribunal upheld the fiscal responsibility, emphasizing that public entities must follow legal procedures before granting economic benefits, reinforcing the principle of statutory compliance in municipal administration.
