Brazilian Senate advances stricter animal cruelty penalties and children's environmental rights

The Brazilian Senate's Constitution and Justice Committee (CCJ) has approved a substitute for a bill that significantly increases penalties for animal cruelty. Under the proposed legislation (PL 4.262/2025), prison sentences for mistreating animals would increase from current levels of 3 months to 1 year to a range of 2 to 5 years. In aggravated cases involving torture, sexual abuse, or the broadcasting of abuse on social media, sentences could reach up to 6 years. Additionally, penalties will increase by one-sixth to one-third if the animal dies.

The bill, originally authored by Senator Confúcio Moura and updated by rapporteur Senator Leila Barros, also establishes a national system for the prevention and detection of such infractions. It introduces new sanctions, such as prohibiting convicted individuals from owning animals or working in professions involving animal contact. The matter now moves to the Chamber of Deputies for analysis.

In a separate legislative development, the Senate has also approved a project (PL 2.225/2024) aimed at guaranteeing the right of children and adolescents to access nature. The bill establishes priority for this demographic in environmental protection and climate risk mitigation, emphasizing the importance of access to healthy natural areas and nature-based education.
