Brazil bans fixed-odds betting and advertising nationwide

The Brazilian federal government has issued Provisional Measure (MP) No. 1.394, which prohibits the exploitation, offering, intermediation, and advertising of fixed-odds betting throughout the country. This regulation applies to companies based abroad if they offer services to individuals located in Brazil. The measure requires operators to make websites and applications unavailable within ten days, setting a deadline of October 5, 2026. Additionally, the rule bans the processing and settlement of payments related to fixed-odds betting, though exceptions are made for closing activities and value restitution.

The regulation also encompasses prediction markets. A technical note from the Ministry of Finance's Secretariat of Prizes and Betting previously concluded that these services share essential elements with fixed-odds betting and that political events are unauthorized objects under existing law.

At the local level, Marília is considering its own legislation. Councilman Marcos Custódio has proposed Bill No. 161/2026, which seeks to prohibit the advertising of sports betting, virtual casinos, and other gambling modalities in municipal public spaces, equipment, and furniture. The local proposal aims to provide a layer of protection for public spaces should federal measures face legal challenges.
