Brazil bans fixed-odds betting via new provisional measure

President Luiz Inácio Lula da Silva has signed Provisional Measure 1.394/2026, which prohibits the exploitation, offering, intermediation, and advertising of fixed-odds betting across Brazil. The measure covers both sports betting and online games, extending the ban to activities previously authorized by states and the Federal District.

Under the new rules, betting platforms must become unavailable starting October 6, and users have until October 5 to voluntarily withdraw their balances. The Ministry of Finance estimates that approximately R$ 1.7 billion is currently held in user balances on these sites. The measure also proposes the creation of an inter-institutional committee to supervise illegal betting and advertising.

The National Association of Games and Lotteries (ANJL) is currently evaluating legal strategies, including a potential challenge in the Supreme Federal Court, but has decided to wait for the upcoming election period before taking action. Meanwhile, the Brazilian Senate has launched a public consultation through its e-Cidadania platform to allow citizens to express support or opposition to the measure.
