Brazil bans online betting and sports wagering via provisional measure FAST-MOVING
President Luiz Inácio Lula da Silva has signed a provisional measure to ban the operation, offering, intermediation, and advertising of online betting and sports wagering in Brazil. The decision covers both physical and virtual environments and includes authorizations previously granted by states and the Federal District. The government justifies the ban as a necessary response to public health concerns, citing the link between gambling and mental health issues such as anxiety, depression, and addiction.
A strict timeline has been established for the transition. New deposits are prohibited as of September 25. Bettors have until October 5 at 23:59 to voluntarily withdraw funds from their accounts. Betting platforms and applications are required to go offline by October 6. Between October 7 and 8, companies must report remaining balances to banks, with financial institutions scheduled to return funds to bettors between October 9 and 14. In cases where direct returns are impeded, Caixa Econômica Federal will manage the payments.
The measure also mandates the removal of all advertising and sponsorship materials by October 5. Companies will not be entitled to compensation for lost profits, investments, or the approximately R$ 2.5 billion paid for operating licenses, as the extinction of authorizations is deemed to be in the public interest. Violators of the new regulations face administrative sanctions, including fines of up to R$ 2 billion.
