Brazil Bill 3022/26 proposes sanctions for delayed medical payments

Bill 3022/26 is currently under analysis in the Brazilian Chamber of Deputies. The proposed legislation aims to authorize Regional Medical Councils (CRMs) to impose administrative sanctions on entities that delay or fail to pay doctors' salaries and fees.

The scope of the bill includes hospitals, health insurance operators, philanthropic entities, cooperatives, and social organizations. Infractions are defined as payments missed after the due date or 'reiterated delays,' which occur three or more times within a 12-month period.

Following an administrative process that ensures the right to defense, companies could face written warnings, fines ranging from R$ 902 to R$ 721,600 (based on the company's annual CRM fee), registration suspension for up to one year, or permanent registration cancellation. Severe penalties like suspension or cancellation would only apply for delays exceeding 90 days, breach of installment agreements, or recidivism.

The bill explicitly states that companies cannot justify non-payment by citing delayed reimbursements from the government or health insurance providers. Authors Eduardo da Fonte and Lula da Fonte noted that while the Federal Council of Medicine (CFM) has similar existing regulations, formalizing them into law provides necessary legal security for these sanctions.
